Three days after Arthur Hufstetler was electrocuted, Vicky Hufstetler filed a petition for a temporary restraining order to stop his employer, Kansas City Southern Railway, from tampering with any potential evidence.
As previously reported, Vicky Hufstetler's attorney, Walter Umphrey of the Provost Umphrey law firm, filed the petition on Aug. 30, 2010, in Jefferson County District Court.
On Sept. 27, an agreed take-nothing judgment and severance order was entered in the case, court papers say.
The order shows that the claim against KCS was severed and settled.
According to the petition, on Aug. 27, 2010, Arthur Hufstetler, a machinist for KCS, was picking up trash around electrical equipment at the railway's Port Arthur yard "when he came in contact with the electrical equipment" and was fatally injured.
Beaumont attorney Mitchell Smith of Germer Gertz represents KCS.
Judge Bob Wortham, 58th District Court, is assigned to the case.
