GALVESTON - A suggestion of death was entered into a Brazoria County man's lawsuit over a two-vehicle accident last year near a Texas City fast food restaurant.
Plaintiff Aaron Lewis died Sept. 14, the three-page document filed Oct. 25 says.
Prior to his death, Lewis sought legal action against Texas City resident Anatolia Cordova, claiming she "violently and unexpectedly" collided with him along a stretch of Palmer Highway on Feb. 19, 2010.
Court papers filed last May before the Galveston County 405th District Court state Lewis was attempting to slowly turn in to a Whataburger parking lot from the eastbound lane when Cordova's green 2001 Nissan struck his vehicle.
Lewis sustained injuries to his head, back, shoulder, spine and legs as a result of the defendant's negligent conduct, the original petition says.
According to the complainant, "his entire body was bruised, battered and contused, and he suffered great shock to his entire system."
The suggestion does not elaborate on the exact circumstances surrounding Lewis's death, but insists "this cause of action is one which survives the death of the plaintiff."
Lewis's lead counsel, Veronica L. Davis, says the defendant's attorneys were notified about his death and "notice shall be made in open court upon locating an address for the relevant heir(s) to proceed with this action."
Visiting judge Frank L. Carmona signed on a related order a day after the notice was filed.
