Restoration company sued for not paying overtime wages

SHERMAN - A Collin County resident has filed a lawsuit against his employer that claims he was not properly paid for overtime work.

Claiming violations of the Fair Labor Standards Act, David Greer filed suit against Image Drycleaners and Laundry Inc. on Dec. 15 in the Eastern District of Texas, Sherman Division.

Greer was employed by the defendant from approximately Nov. 2009 until his termination in Aug. 2011. He claims that during his employment, he was improperly classified and paid as an exempt employee. He was not paid overtime at the required rate of one and one-half times his regular rate of pay for any hours worked in excess of 40 hours each week. Greer states that during his employment, he worked an average of 15 hours of overtime each week.

According to the allegations, Greer was terminated immediately after reporting to the defendant's president that he was not being properly paid.

The defendant is accused of violating the Fair Labor Standards Act and of retaliation against Greer.

The plaintiff is asking for an award of unpaid overtime compensation, liquidated damages, back pay and lost benefits, front pay and lost benefits, interest, court costs, and attorney's fees. Greer is also asking the Court for reinstatement to the position and pay grade which he previously held.

Greer is represented by Laura E. Calhoun and Connie Pena of Calhoun Pena Corsentino P.C. in Frisco.

A jury trial is requested.

U.S. District Judge Michael H. Schneider is assigned to the case.
