Correction: Suit does not allege embezzlement

An April 2 article in the Southeast Texas Record incorrectly named the charges against a defendant.

The suit described in "Maritime company claims manager embezzled $100K" does not include charges of embezzlement. The counts against the defendant in the lawsuit are breach of contract, unjust enrichment, conversion, breach of fiduciary duty and fraud.

According to the definitions on USLegal.com, conversion is very similar to theft, but it is a civil action, not a criminal action. Embezzlement is a crime that can be punished by imprisonment and other remedies, such as an order of restitution.
Another definition states that if one has a Good Faith belief that one has a right to withhold property or devote it to one's own use, the conversion cannot be fraudulent, and there is no embezzlement.
The Record apologizes for the error and for any inconvenience its error may have caused the defendant.
