Fall at condo complex leads to lawsuit

GALVESTON - After injuring her ankle at a Galveston condominium complex two years ago, Linda Borton has filed a lawsuit.

Borton's suit against Four Seasons On The Gulf, filed Dec. 7 in Galveston County District Court, states the plaintiff fell at the property on the night of Dec. 9, 2009, as a result of "some unseen obstruction in her path."

Borton claims she was making her way to a condo by traversing a walkway when she fell and suffered "immediate and serious" harm to her ankle.

"This accident was caused by the negligence of grounds keepers, whether employees or agents of Four Seasons Condominiums, in maintaining unobstructed, level and safely manicured grounds and/or negligent in the installation and maintenance of proper lighting or signage of the walkways or grounds," the suit says.

Recent court documents assert the plaintiff "has required the services of several medical practitioners, medical specialists and at least one surgeon who have analyzed and treated (her) for her injuries."

"Medical specialists have attempted to mitigate her injuries with only partial success," the suit says.

"Despite these medical interventions, Ms. Borton remains impaired to a significant degree as a result of this accident."

Consequently, she seeks at least $100,000 in damages and a jury trial.

Borton is represented by The Jones Law Firm.

The case has been assigned to Galveston County 122nd District Court Judge John Ellisor.
