BISD sued for bus driver's collision

Area resident Mark Smith has filed suit against the Beaumont Independent School District and one of its bus driver's, Elaina Sylvester, alleging the defendants caused a collision last April.

The suit was filed Dec. 27 in Jefferson County District Court.

According to the lawsuit, on April 19, 2010, Smith was driving south on MLK in Beaumont when Sylvester rear-ended him at a traffic light while driving a BISD school bus.

The suit faults BISD with negligent entrustment and Sylvester with negligently failing to keep a proper lookout and apply her brakes in a timely manner.

The plaintiff is suing for her past and future mental anguish, lost wages, impairment and medical expenses, plus all court costs.

Port Arthur attorney Gordon Friesz of the McPherson, Hughes, Bradley, Wimberley, Steele & Chatelain represents the plaintiff.

Judge Donald Floyd, 172nd District Court, is assigned to the case.
