The parents of a physically and intellectually handicapped child have filed suit against the truck driver who they claim struck their vehicle while the mother was pregnant.
Jason and Lisa Moore claim they were struck by an 18-wheeler being driven by defendant John Blanchard, who was working for defendant A&R Logistics at the time of the collision.
Lisa Moore was pregnant when the accident occurred on Sept. 20, 2000, according to the complaint filed Dec. 12 in Jefferson County District Court.
Because of the collision, the Moores' unborn daughter sustained injuries and has permanent physical and intellectual deficits, the suit states.
Due to their daughter's health condition, the Moores have incurred medical costs, the complaint says.
They say she will lose her earning capacity and has suffered from physical impairment, physical pain and mental anguish. In addition, she will incur costs of long-term care taking, according to the complaint.
A&R Logistics negligently entrusted the truck to Blanchard and failed to adequately supervise and train him, the suit states.
Blanchard negligently drove too fast, followed the Moores' vehicle too closely, failed to keep a proper lookout, drove while distracted and failed to adjust his speed to avoid a collision, the complaint says.
In their complaint, the Moores are seeking a judgment in excess of the minimum jurisdictional limits of Jefferson County District Court, plus costs, pre- and post-judgment interest and other relief the court deems just.
Clay Dugas and Mike Jacobellis of Beaumont will be representing them.
The case has been assigned to Judge Bob Wortham, 58th District Court.
