MARSHALL - The U.S. Postal Service is being sued after one of its workers allegedly turned in front of another vehicle and caused a wreck.
Brandy Graham filed suit against the United States of America on Jan. 9 in the Eastern District of Texas, Marshall Division.
The accident occurred on July 10, 2009, while Graham was traveling in a 2003 Mitsubishi Galant westbound on Tenneryville Road in Longview.
According to the complaint, U.S. Postal Service employee Bonnie Gilbert Bell was also driving a vehicle westbound and turned left in front of Graham's vehicle, colliding with the car.
The defendant is accused of violating the Texas Transportation Code and acting negligently for failing to keep a proper lookout, failing to timely apply brakes, failing to control the vehicle and failing to act in a reasonable manner.
Graham argues that the defendant is liable for negligent undertaking of the training, supervision and instruction of Bonnie Bell.
The plaintiff is seeking damages for medical care and expenses, physical pain and suffering, mental anguish, physical impairment, loss of earning capacity, damage to her automobile, loss of use of her vehicle since the day of the collision, interest and court costs.
Graham is represented by Marty Young of Gourdarzi & Young in Gilmer.
U.S. District Judge Rodney Gilstrap is assigned to the case.
