Suit says car struck while backing out of driveway

A Beaumont man has filed suit against the driver who he claims struck the vehicle in which he rode while it attempted to exit a driveway.

Nilsheila Bailey filed a lawsuit Dec. 21 in Jefferson County District Court against Kevin Maurice Bowles and Christopher Leroy Nobles.

In his complaint, Bailey claims he rode in a vehicle Bowles was attempting to navigate out of a driveway when he failed to yield the right-of-way to oncoming traffic on Feb. 6, 2010. Nobles, who was driving on the road in front of the driveway, failed to control his speed and both vehicles collided, according to the complaint.

Because of the collision, Bailey sustained severe, stabbing pain in his neck, shoulder and back and incurred medical costs, the suit states. In addition, he lost his earnings and his earning capacity and sustained physical impairment, physical pain and mental anguish, the complaint says.

Bailey blames Bowles and Nobles for causing the collision, saying both drivers negligently failed to keep a proper lookout, failed to timely apply their brakes, failed to control the speed of their vehicles and entered a roadway without yielding the right-of-way to other vehicles.

In his complaint, Bailey seeks an unspecified judgment, plus interest, costs and other relief the court deems just.

Jonathan C. Juhan and J.J. Bragg of Beaumont will be representing him.

Judge Donald Floyd, 172nd District Court, has been assigned to the case.
