Multi-car pileup in Port Arthur leads to lawsuit

A Groves man has filed suit against the driver who he claims struck his vehicle, causing a multi-car collision.

Luis Marquez claims he was driving west on State Highway 73 in Port Arthur on Dec. 6 when the vehicle in front of him slowed due to heavy traffic. Suddenly, defendant Brandon Click, who was driving a vehicle for Southwestern Bell Telephone Co., failed to control his speed and rear-ended Marquez's vehicle, according to the complaint filed Dec. 22 in Jefferson County District Court. In turn, Marquez rear-ended the vehicle in front of him, the suit states.

Because of the collision, Marquez sustained neck injuries, incurred medical costs and experienced mental anguish, physical pain, suffering and disability, the complaint says. In addition, he claims he lost his earning capacity, incurred property damages to his 2009 Saturn and sustained physical impairment.

Click negligently drove too fast, failed to keep a proper lookout, failed to timely apply his brakes and failed to keep a safe distance behind traffic, according to the complaint.

In his complaint, Marquez is seeking a judgment in excess of the minimum jurisdictional limits of Jefferson County District Court, plus costs, pre- and post-judgment interest and other relief the court deems just.

Clay Dugas and Mike Jacobellis of Beaumont will be representing him.

The case has been assigned to Judge Donald Floyd, 172nd District Court.
