MARSHALL - Two Marshall residents have filed a personal injury lawsuit against the employer of a truck driver, who failed to stop at an intersection and collided into their vehicle.

Casey Holladay and Kevin Frazier filed suit against Transforce Inc. on Feb. 3 in the Eastern District of Texas, Marshall Division.

The accident occurred on Aug. 2, 2011 while Holladay was driving a 2000 Jeep Grand Cherokee on Highway 80 in Marshall. Frazier was a passenger in Holladay's vehicle.

According to the lawsuit, Danny Lajoie, an employee of defendant Transforce, was driving a tractor-trailer and failed to stop at a stop sign at the intersection. Lajoie drove directly into Holladay and Frazier's lane of travel.

The tractor-trailer driver is accused of failing to yield the right of way, failing to maintain proper attention, failing to take evasive action to avoid a collision, entering the roadway into Holladay's lane when it was unsafe to do so.

The defendant is accused of common law negligence and violating the Federal Motor Carrier Safety Regulations and the Texas Transportation Code.

Holladay and Frazier are seeking damages for physical pain and mental anguish, emotional pain, torment and suffering, medical expenses, physical impairment, loss of earnings, loss of earning capacity, interest and court costs.

The plaintiffs are represented by Tyler attorney Keith Miller and Blake C. Erskine of Erskine & McMahon in Longview.

A jury trial is requested.
