Three plaintiffs seek payout from insurer for intoxicated driver

Three Jefferson County residents seek money from their insurance company after they claim they sustained injuries in a collision with an allegedly intoxicated driver.

Charlie Moody, Marion Moody and Deborah Trahan, as next friend of minor Lacie Trahan, filed a lawsuit Feb. 21 in Jefferson County District Court against State Farm Mutual Automobile Insurance Co.

In their complaint, the plaintiffs allege Larry Joseph Netterville, who was allegedly driving while he was intoxicated, failed to keep a proper lookout and struck the front driver's side of their vehicle on April 1, 2010.

Because of the collision, the plaintiffs experienced physical pain, suffering and mental anguish, according to the complaint.

They blame Netterville for causing the collision, saying he negligently failed to keep a proper lookout, failed to control his speed, failed to drive in a safe manner, failed to apply his brakes to avoid a collision, failed to stay in his lane and drove while intoxicated.

At the time of the accident, the plaintiffs had insurance through State Farm.

In their lawsuit, the plaintiffs seek to recover damages from their insurance company. They also seek pre- and post-judgment interest at the legal rate, attorneys' fees, costs and other relief the court deems just.

Judge Donald Floyd, 172nd District Court, has been assigned to the case.
