GALVESTON - A local woman who alleged her landlord attempted to force her out of a contract for a Galveston rental home has submitted a notice to nonsuit, recent court documents say.
Lisa Turner, through her attorney Norma Venso of Houston, entered the one-page document into her June 2011 lawsuit against Daisy Salinas on Feb. 13.
Turner filed suit against Salinas in Galveston County Court at Law No. 3 last June 27, alleging the latter disregarded her intention to stay pursuant to her signed lease to the residence in the 7000 block of Youpon Drive.
Both parties signed off on a lease which called for payment of $1,100 monthly rent for a term from Jan. 1, 2011, to Jan. 1, 2012, last December, the suit stated.
The plaintiff claimed to discover problems with the stove and one bath after she moved in and was informed by the Salinas's agent and boyfriend that workers had poured concrete down the drain.
The original petition further explained that Salinas attempted to terminate the contract based on the advice of a local justice of the peace, who supposedly told the respondent she needed no reason to end the vacancy.
It added the defendant posted a "Notice to Terminate Vacancy" note on the subject property's door despite being paid the June rent and notified of Turner's decision not to break the lease, insisting Turner and her children experienced threats and harassment.
Salinas, who was represented by Bettison Doyle Apffel & Guarino, countered the allegations as well as requested a jury trial in a formal response filed July 15, 2011.
