League City residents' case against Kemah cop closed

GALVESTON - A Galveston County Court judge recently signed off on an order to close two League City residents' lawsuit against the city of Kemah and one of its police officers.

Galveston County Court at Law No. 3 Judge Christopher Dupuy issued the order dismissing Robert James Beasley and Vera Ann Bila's claims against the city on Feb. 6, ending the six-month-old lawsuit.

Beasley and Bila originally filed suit against Kemah patrolman Matthew Louis Macik last July 15 in response to a two-vehicle accident at the intersection of Highway 146 and FM 518 on Oct. 13, 2010.

According to the original petition, Macik disregarded traffic rules and regulations when he collided with the plaintiffs.

The complainants were crossing Highway 146 while Macik, who was reportedly on duty, traveled northbound in the turn only lane headed to the aforementioned intersection at the time of the alleged incident, the suit says.

The officer drove at a high rate of speed despite not responding to an emergency nor activating his siren or emergency lights, Beasley and Bila said.

The plaintiffs were subsequently taken to a nearby hospital.

Shortly after being served, Macik submitted a motion to dismiss and a conditional motion to sever while his employer entered an original petition along with a plea to the jurisdiction and its own motion to dismiss.

Macik was then nonsuited.
