MARSHALL - An Athens woman files a personal injury lawsuit after her car was struck by another vehicle in a convenience store parking lot.

Sabrina Johnson, individually and as next friend for two minor children, filed suit against Chisholm Trail Oilfield Service Inc. on March 6 in the Eastern District of Texas, Marshall Division.

The incident occurred on Aug. 24, 2011, as Johnson was driving a Nissan in a convenience store parking lot in Athens. Johnson's two minor children were passengers in her vehicle.

According to the lawsuit, Johnson's vehicle was struck by a 2007 Ford truck that was being driven by Darla Gray, but owned by Chisholm Trail Oilfield Service.

Johnson injured her neck and back in the accident and her children suffered injuries to their back, pelvis and abdomen, the suit claims.

Gray is accused of negligence in the manner in which she operated her company vehicle.

Johnson argues that Chisholm Trail Oilfield Service is legally liable for Gray's actions under the theory of respondeat superior.

The plaintiff is asking for an award of damages for physical pain and mental anguish, medical expenses, physical impairment, loss of earnings, loss of earning capacity, interest and court costs.

Johnson is represented by Blake C. Erskine of Erskine & McMahon in Longview and Tyler attorney Keith Miller. A jury trial is requested.

U.S. District Judge Rodney Gilstrap is assigned to the case.
