Trucking company sued after tractor-trailer fails to stop at red light

MARSHALL - A Dallas County woman has filed a lawsuit against a trucking company after a tractor-trailer struck her vehicle while she was stopped at a red light.

Venesia Y. Adams filed suit against Terry Grubb and Maverick Transportation on March 5 in the Eastern District of Texas, Marshall Division.

The incident occurred on June 21, 2010, as Adams was stopped at a red light. She states that defendant Grubb failed to control his tractor-trailer and rear ended her vehicle.

Adams suffered brain injuries and significant back and neck problems, according to the lawsuit.

Grubbs is accused of negligence for failing to keep a proper look out, failing to maintain an appropriate distance from the vehicle in front of him, failing to maintain his lane of travel and for failing to act as a reasonable truck driver.

Adams argues that Maverick is liable for the actions of its employee under the doctrine of respondeat superior. Maverick is also accused of negligence entrustment for entrusting Grubb with the vehicle.

The plaintiff is asking for an award of damages for physical pain and suffering, mental anguish, disfigurement, physical impairment, medical expenses, loss of earning capacity, loss of household services, property damages, exemplary damages and interest.

Adams is represented by William H. Stout and Graham E. Sutliff of Sutliff & Stout in Houston and Marshall attorney Josh B. Maness. A jury trial is requested.

U.S. District Judge David Folsom is assigned to the case.
