GALVESTON - Corpus Christi resident Adrianne Bowens has filed suit against Chrysler Group LLC over a reportedly defective vehicle she purchased last August.
Recent court documents filed March 9 in Galveston County District Court show Bowens bought a 2010 Dodge Journey from Cantwell Dodge Jeep Chrysler in Kingsville for approximately $15,726.92 on Aug. 23, 2011.
According to the original petition, the plaintiff has had numerous problems with the vehicle.
"Since purchase, the vehicle has encountered an excessive number of defects, including but not limited to issues with the vehicle's ignition, winding noise, vibration, windows, front seat, washer indicator light and other defects listed in repair orders, warranty history and indentified through discovery," the suit says.
It additionally points out that "the limited remedy in the defendants' warranty fails of its essential purpose and deprives the plaintiff of the substantial value of the bargain because the defendant or its authorized dealerships did not correct the defects within a reasonable time."
"Therefore, any purported limitation of remedies is ineffective," the suit says.
Bowens insists she timely and properly revoked acceptance of the vehicle as well as requested a refund of the purchase price, consequently seeking $40,749 and the return of her finance charges and costs of maintaining insurance.
She is represented by attorney Richard C. Dalton of Scott, La.
Galveston County 122nd District Court Judge John Ellisor is presiding over the case.
