Debt collection agency sued for claiming to be law firm

SHERMAN - A Texas debt collection agency is being sued for violating federal regulations by claiming to be a law firm in an effort to collect a consumer debt.

Claiming violations of the Fair Debt Collection Practices Act, Sharon Pifer filed suit against Lockhart Morris & Montgomery Inc., John Does and Jane Does on March 20 in the Eastern District of Texas, Sherman Division.

According to the lawsuit, the defendants placed calls to Pifer at her place of employment, demanding payment for an alleged consumer debt. The defendants allegedly threatened to garnish Pifer's wages and threatened Pifer's nursing license.

Pifer claims that the defendants stated that they were a law firm, when they are not.

The defendants are accused of engaging in abusive, deceptive and unfair practices in violation of the Fair Debt Collection Practices Act and the Texas Debt Collection Practices Act.

The defendants are also accused of invasions of Pifer's privacy and of making illegal efforts to collect a consumer debt from Pifer.

The plaintiff is asking the Court for an award of actual damages, statutory damages, costs and attorney's fees.

Pifer is represented by Kim A. Lucas of Kyle Mathis & Lucas in Dallas.

A jury trial is requested.

U.S. District Judge Richard A. Schell is assigned to the case.
