GALVESTON – Arlington residents Peggie Prado and Robinson Cartagena Collazo allege a large metal object belonging to Webber LLC caused a single-vehicle accident two years ago.
According to a lawsuit filed March 15 in Galveston County District Court, the object interfered with the vehicle carrying Prado, Collazo and their five young children on March 15, 2010, as they traveled along a stretch of the Gulf Freeway in League City, resulting in the crash.
Court papers show Prado was the driver of a 1998 Land Rover Discovery with Collazo and the minors, who join their parents as plaintiffs in the case, as her passengers.
"The plaintiffs' vehicle impacted with a large metal object that was in the roadway, similar to a road cover," the original petition says.
"Due to the impact of the large metal object, similar to a road cover, which was elevated from the ground and obstructing drivers' path, plaintiff Peggie Prado's vehicle moved from its course of travel and impacted the concrete median on the freeway."
The suit asserts the defendant placed the cover as part of a highway construction project, claiming there were no orange cones, barricades or warning devices.
Webber is faulted for negligent activity, negligent hiring and premises liability.
Consequently, the plaintiffs seek unspecified monetary damages.

Galveston County 10th District Court Judge David Garner is presiding over the case.
