A Beaumont man has filed suit against the driver he claims struck him as he was driving through a parking lot.
Dennis J. Louis Jr. claims he was driving in a private parking lot on Sept. 8, 2010, when defendant Leoncio V. Montiel, who was operating a vehicle in the same lot, struck Louis's vehicle.
Because of the collision, Louis incurred medical costs, experienced physical pain and suffering, sustained physical impairment and mental anguish and lost his earning capacity, according to the complaint filed March 8 in Jefferson County District Court. In addition, he suffered disfigurement, the suit states.
Montiel negligently failed to control his speed, drove too fast, failed to keep a proper lookout, failed to keep a safe distance between his vehicle and Louis's, failed to swerve to avoid a collision, failed to bring his vehicle to a stop to avoid a collision, failed to timely apply his brakes, failed to obey a traffic signal and drove recklessly.
In his complaint, Louis is seeking actual damages in excess of the minimum jurisdictional limits of Jefferson County District Court, plus pre- and post-judgment interest at the highest legal rate, costs and other relief the court deems just.
