Mother, daughter claim injuries from crash

Two women have filed suit against the driver who they claim slammed into the side of the vehicle in which they were riding.

Lauren M. Smith was driving her mother, Shelli Smith, in Jefferson County on Sept. 9, 2011, when suddenly defendant Mdabdullah Al Mahmood slammed into the passenger side of the Smith vehicle, according to the complaint filed March 21 in Jefferson County District Court.

Because of the collision, the Smiths have sustained neck, back, shoulder and hip injuries; incurred medical costs; and experienced physical pain, suffering and impairment, the suit states. They also lost earnings and consortium, the complaint says.

The Smiths blame Mahmood for causing the collision, saying he negligently failed to keep a proper lookout, failed to swerve to the left or right to avoid the collision, failed to yield the right-of-way while exiting a private drive, drove too fast and failed to brake to avoid the collision.

In their complaint, the Smiths are seeking damages within the jurisdictional limits of Jefferson County District Court, plus pre-judgment interest at the maximum rate allowed by law, post-judgment interest at the legal rate, costs and other relief the court deems just.

The case has been assigned to Judge Milton Shuffield, 172nd District Court.
