A Louisiana couple has filed a personal injury lawsuit against a truck driver after he crashed into their vehicle, which was stopped on the shoulder of Interstate 10.
Angelena Gerage and Nickie John Gerage filed the lawsuit against David L. Belair and Metropolitan Trucking Inc. on April 5 in the Eastern District of Texas, Beaumont Division.
The incident occurred on Oct. 27, 2010, while the plaintiffs were traveling eastbound on IH-10 in Vidor. According to the lawsuit, the Gerages pulled their pickup off the interstate and onto the shoulder. They were at a complete stop when defendant Belair drove onto the shoulder of IH-10 and struck the Gerage's truck, the suit says.
The suit states that the investigating officer concluded that Belair failed to drive in a single lane.
Defendant Belair is accused of negligence for failing to keep a proper lookout, failing to drive in a single lane, failing to yield the right of way, driving inattentively and for failing to control his speed.
Defendant Metropolitan Trucking is accused of negligence for authorizing Belair to drive the truck and for the maintenance of the truck or supervision of Belair in the operation of the truck.
The couple is asking for an award of damages for medical expenses, property damages, mental anguish, physical impairment, interest, and court costs.
The plaintiffs are represented by George Chandler of Chandler Law Offices in Lufkin.
U.S. District Judge Ron Clark is assigned to the case.
