The widow of a recently deceased man has filed suit against the allegedly intoxicated driver who she claims struck and killed her husband.
Mayra Chavez claims her husband, Francisco Reyes Chavez, was traveling in the outside lane in the 2300 block of U.S. Highway 69 on March 17 when defendant Randy Blanchard, who was pulling out of a parking lot at 2328 U.S. 69, failed to yield the right-of-way and struck Francisco Chavez.
Due to the accident, Francisco Chavez died while his wife and their two children suffered a pecuniary loss and lost his companionship and society, according to the complaint filed March 28 in Jefferson County District Court. In addition, Mayra Chavez and her two children sustained mental anguish and lost their inheritance, the suit states.
At the time of the collision, Blanchard negligently drove while intoxicated, failed to yield the right-of-way and failed to keep a proper lookout, the complaint says.
In her complaint, Mayra Chavez is seeking actual and punitive or exemplary damages, plus costs, pre- and post-judgment interest at the maximum rate allowed by law and other relief the court deems just.
