A debt collection agency is being sued for continuing to contact a debtor even after it received a cease and desist letter.
Edith Edwards filed suit against Capital Management Services on April 20 in the Eastern District of Texas, Beaumont Division.
According to the lawsuit, Edwards' attorney mailed the defendant a cease and desist letter in October 2010 regarding a debt from DB Servicing Corp.
Edwards claims that the collection agency contacted him around November 2011 in an attempt to collect on the debt.
The defendant is accused of violating the Fair Debt Collection Practices Act.
The plaintiff is asking the court for an award of statutory damages of $1,000, plus court costs and attorney's fees.
Edwards is represented by Adam T. Hill of Krohn & Moss Ltd. in Chicago.
A jury trial is requested.
U.S. District Judge Ron Clark is assigned to the case.
