Company doing pier repair says it was not paid by seafood business

GALVESTON - Island Marine Piledrivers Inc. claims Texas Gulf Seafood Inc. owes it $25,400 for cleaning and reconstruction services.

A lawsuit filed April 23 in Galveston County Court at Law No. 1 alleges Texas Gulf Seafood hired Island Marine Piledrivers to provide labor to a pier near the defendant's property earlier this year.

The plaintiff was instructed to remove and replace some of the partially submerged pilings supporting the pier, which had suffered damage and deterioration as a result of the elements.

Texas Gulf Seafood in turn consented to a proposal calling for it to pay a rate of $400 to remove and another $400 to replace each damaged piling plus $1,000 per day for additional labor for the removal and replacement of pier decking.

The project began in early February.

Island Marine Piledrivers claim Texas Gulf Seafood paid the first two invoices, but did not pay a bill dated Feb. 24 for $20,600 that was adjusted down to $15,400 in response to a project-related complaint.

Another invoice in the amount of $10,000 was issued in early March, however, Texas Gulf Seafood also failed to pay for it, the suit claims.

The plaintiff insists it performed its tasks in accordance to the defendant's wishes.

Attorney Thomas W. McQuage of Galveston is representing Island Marine Piledrivers.

Galveston County Court at Law No. 1 Judge John Grady is presiding over the case.
