A defendant in a suit filed over an injury at Mardi Gras has brought a cross-claim claim against another defendant.
Frederick Jones filed suit against Mardi Gras Southeast Texas and AAA Rentals on Aug. 29 in Jefferson County District Court, alleging he was injured when a Mardi Gras tent fell on him during the March festival.
On April 5, AAA Rentals filed an amended answer and cross-claim against Mardi Gras Southeast Texas, court records show.
The cross-claim alleges Mardi Gras Southeast Texas breached its contract with AAA Rentals by failing to secure it as an additional insured on its insurance policy.
The lawsuit claims that on March 5, 2011, Jones was attending the Mardi Gras in Port Arthur when a tent leased by the defendants fell on him.
Jones alleges the defendants were responsible for the condition of the tent and should have made sure it was safe.
He is suing for his alleged past and future medical expenses, mental anguish, pain, impairment, disfigurement and lost wages, plus all court costs.
