MARSHALL - An Alabama truck driver has filed a lawsuit against trucking company after a tractor trailer rear-ended his truck.

George Stutts filed suit against S. Easley Trucking Co. on April 23 in the Eastern District of Texas, Marshall Division.

The incident occurred on May 3, 2011, as Stutts was traveling south on North Loop 256 in Palestine. Stutts states that his tractor-trailer was stopped at a red light, when he was hit from behind by a truck owned by the defendant.

The defendant's driver was cited for failing to control his speed at the time of the accident.

The defendant is accused of negligence for failing to control speed and failing to maintain a proper lookout.

The plaintiff is asking the court for an award of damages for medical expenses, loss of income, physical impairment, pain, suffering, mental anguish, loss of earning capacity, pain, suffering, mental anguish, court costs, attorney's fees and interest.

Stutts is represented by J. Mark Mann, G. Blake Thompson, and Stacie H. Tandy of The Mann Firm in Henderson.

U.S. District Judge Rodney Gilstrap is assigned to the case.
