Collision on interstate service road leads to lawsuit

A woman has filed suit against the driver of a tractor trailer she claims collided with her vehicle.

Magan Fontenot claims she was attempting to make a southbound turn from the outside lane of the Interstate 10 Eastbound Service Road in Beaumont on Nov. 16 when defendant George William Cox, who was driving a tractor-trailer owned by defendant Western Express, struck her vehicle with his tractor as he attempted to turn from the middle turn lane.

Because of the collision, Fontenot suffered severe injuries to her neck and back, experienced physical pain and mental anguish and sustained disfigurement, according to the complaint filed April 26 in Jefferson County District Court. She also suffered physical impairment and incurred medical costs, the suit states.

Cox negligently failed to keep a proper lookout, failed to keep his vehicle under proper control and failed to make a proper turn, the complaint says.

In her complaint, Fontenot is seeking actual damages within the jurisdictional limits of the court, exemplary damages, pre- and post-judgment interest, costs and other relief the court deems just.

Charlton P. Hornsby of Beaumont will be representing her.

The case has been assigned to Judge Bob Wortham, 58th District Court.
