Claiming the debt collector waited too long to call him, a Lumberton resident has filed a lawsuit against the debt collector for violations of the Fair Debt Collection Practices Act.
Mark Carter filed suit against Dynamic Recovery Services Inc. on May 10 in the Eastern District of Texas, Beaumont Division.
Carter states that Dynamic Recovery Services contacted him in April 2012 over an alleged debt. The collection agency told Carter to look over "important legal documents" and to sign them to "prevent this from immediately taking place."
Carter understood that the agency was threatening to sue him. A few weeks later, the agency called Carter and threatened him with legal action.
According to the lawsuit, the defendant's attempt to collect on the debt was past the statute of limitations.
The defendant is accused of violating the Fair Debt Collection Practices Act.
The plaintiff is asking the Court for an award of actual, statutory, and punitive damages, court costs and attorney's fees.
Carter is represented by Jody B. Burton of Lemberg & Associates in Stamford, Conn.
A jury trial is requested.
