Suit alleges medical provider responsible for patient's fall

Although William McGhee's hip surgery went off without a hitch, a lawsuit claims the patient was left unattended and allowed to fall on his way to the bathroom, which resulted in an infection and eventual death.

Representing McGhee's estate, Maxine McGee filed suit against the Medical Center of Southeast Texas on May 10 in Jefferson County District Court, alleging the medical provider failed to monitor and assist McGhee.

According to the lawsuit, on July 1, 2010, McGhee underwent successful hip surgery. Two days later, he was transferred to the Medical Center for rehabilitation.

On the day McGhee was scheduled to be discharged, July 9, 2010, he attempted to go to the bathroom unassisted and fell, re-injuring his hip. A hospital employee found him lying in a pool of blood on the bathroom floor, according to the suit.

An infection ensued and McGhee went in for a second surgery on July 15, 2010. His condition continued to deteriorate until he died on Aug. 4, the suit states.

Not only is the defendant accused of leaving McGhee unattended, but also failing to keep the bathroom clean.

Maxine McGhee and her family are seeking wrongful death damages.

Houston attorney Craig Lewis represents them.

Judge Milton Shuffield, 136th District Court, is assigned to the case.
