Defendants in two consolidated petitions stemming from one injury have been dismissed from the litigation.

On the same day, Brandon Fox, who injured his right arm, filed two petitions to perpetuate testimony, one against ExxonMobil and other against Brock Services

On Oct. 14 Judge Gary Sanderson, 60th District Court, ordered that the two petitions, both filed July 22 in Jefferson County District Court, be consolidated, court records show.

Court records further show that on April 2 Fox filed a motion to dismiss, stating that he no longer desires to prosecute his cause of action against the defendants.

The following day, Judge Sanderson granted the motion, dismissing the defendants without prejudice.

Fox, a Brock Services employee, claims he was working at ExxonMobil in Beaumont on May 1, 2011, when his equipment malfunctioned, causing him to sustain a severe right arm injury.

He was suing for his alleged past and future medical expenses, mental anguish, pain, impairment, disfigurement and lost wages, plus all court costs.

James E. Payne and Ronnie Turner Jr. of Provost Umphrey Law Firm in Beaumont represent Fox.
