Rider forced to lay down moped to avoid collision, suit alleges

In order to avoid a collision with Gialam Tran, who allegedly ran a stop sign, Larry Penn says he was forced to lay down his moped.

On May 17 Penn filed suit against Tran in Jefferson County District Court.

According to the lawsuit, on Jan. 28 Tran allegedly failed to yield the right of way at a stop sign, forcing Penn to lay down his moped to avoid striking him.

The suit does not state where the incident occurred.

Tran is accused of negligently failing to maintain a proper lookout and apply his brakes in a timely manner.

The plaintiff is suing for his alleged past and future medical expenses, mental anguish, pain, impairment, disfigurement and lost wages, plus all court costs.

Beaumont attorney David Wilson of Provost Umphrey represents him.

Judge Gary Sanderson, 6oth District Court, is assigned to the case.
