Answers filed in man's case over injury from moving concrete

GALVESTON - Each of the defendants in a local man's lawsuit over injuries he reportedly sustained while moving concrete mats has filed an original answer, recent court records show.

Premier Concrete Products, Inc. submitted its response May 14 while Ardis Webber, doing business as Webber Transport, entered his rebuttal 10 days later.

Galveston resident Mark Williams claims in a suit filed April 11 in Galveston County Court at Law No. 1 that he hurt himself as he assisted in unloading concrete mats on or about April 19, 2010.

According to the original petition, Williams was climbing down from the back of the defendant's truck after he completed the task in question when the vehicle began to move.

Williams alleges he fell off from the rear and sustained "severe" injuries.

Both respondents contend the alleged incident occurred because of pre-existing conditions the plaintiff may supposedly have.

They also assert that Williams was negligent in that he did not use caution when removing the mats.

In his answer, defendant Webber insists the subject event was an Act of God.

Each response states that the plaintiff failed to mitigate his damages.
