A waste incineration facility claims it was forced to shut down for a short period of time after it lost its natural gas supply.
Veolia ES Technical Solutions claims it had to shut down its Port Arthur facility because defendant Kinder Morgan failed to provide it with a steady supply of natural gas it needed to operate the facility.
Kinder Morgan blames the shortage on defendant Houston Energy, according to the petition to perpetuate testimony filed June 7 in Jefferson County District Court.
Houston Energy created a contamination in the gas supply lines, which delivered gas to Veolia, the petition states.
Because of the gas supply shortage, Veolia sustained significant damages, the petition says. Veolia claims it intends to file a lawsuit against someone, but would like to first interrogate knowledgeable officials from both companies to learn more information about the occurrence.
In addition to the depositions, Veolia is seeking an order that Kinder Morgan and Houston Energy produce documents that reveal all correspondences exchanged between the companies regarding the natural gas supply, a map identifying the pipeline and where the interruption occurred and any other documents that relate to the incident.
It will be represented by Greg M. Dykeman and Stacie L. Augustine of Strong, Pipkin, Bissell and Ledyard in Beaumont.
The case has been assigned to Judge Milton Shuffield, 136th District Court.
