A Beaumont woman has filed suit against the driver who she claims rear-ended a vehicle behind her, causing her to sustain injuries.
Marguerrite Powell claims defendant Taffy Ann Cook rear-ended a vehicle behind Powell as Powell was in the Port Arthur Walmart parking lot. Cook was cutting across parking lanes when the collision occurred, according to the lawsuit filed June 18 in Jefferson County District Court.
Because of the collision, Powell incurred medical costs; experienced pain, suffering, physical impairment and mental anguish; and lost her earning capacity, the suit states. She also suffered disfigurement, the complaint says.
Powell blames Cook for causing the collision, saying she negligently failed to control her speed, drove too fast, failed to keep a proper lookout, failed to maintain a safe distance between her vehicle and Powell's, failed to swerve to avoid a collision, failed to stop, failed to timely apply her brakes and failed to observe traffic signals.
In her complaint, Powell is seeking actual damages, plus pre- and post-judgment interest, costs and other relief the court deems just.
