GALVESTON - Local resident Mary Moses claims she was injured whiled working at the Galveston cruise terminal almost six months ago, recent court documents say.

According to a lawsuit against Suderman Contracting Stevedores Inc., an employee with the defendant drove a forklift into Moses as she was screening baggage Feb. 15.

Court papers were filed July 5 in Galveston County District Court.

Moses says the forklift knocked her from behind and caused her to seriously injure her left knee, right hip and her entire right side.

"The acts of negligence committed by the defendant's agents, servants and/or employees arose directly out of and was done in prosecution of the business that they were employed to do by their employer, who is therefore liable under the doctrine of respondeat superior for the negligent actions of its employees," the original petition states.

The suit insists that "the hazardous forklift operation was under the sole management and/or control of the defendant."

Consequently, the complainant sues for physical pain and impairment, mental anguish, lost wages and medical expenses.

She seeks a jury trial.
