TYLER - A former employee of a Tyler company has sued the company claiming that they violated federal regulations by not paying him overtime compensation.
Chris Daughtry filed suit against Act Fast Delivery of Tyler Inc. and Act Fast Delivery of Texas Inc. on June 29 in the Eastern District of Texas, Tyler Division.
The defendant is accused of violating the Fair Labor Standards Act by failing to pay Daughtry for all of his workday activities.
Daughtry was employed in a non-exempt position in which he worked for payment of straight time and overtime.
"Defendants have repeatedly and consistently failed to pay Plaintiff for all time worked, which is integral and indispensable to his principal activities in his continuous workday," the lawsuit states.
The plaintiff is seeking an award of damages for unpaid wages, overtime, liquidated damages, court costs, attorney's fees, and interest.
Daughtry is represented by Rosemary Sage Jones of Grant T. Gaston of Ramey & Flock P.C. in Tyler.
A jury trial is requested.
