Knife River sued after driver involved in crash

A woman claims she endured pain and suffering after a driver rear-ended the vehicle in which she rode.

Kori Lynette Boyd filed a lawsuit July 12 in Jefferson County District Court against Douglas James Nelson Jr. and Knife River Corp.

In her complaint, Boyd alleges she rode in a vehicle James Scoggins drove north on S. Market Street in Hearne on April 21, 2011. When Scoggins approached highway construction, he slowed his vehicle, according to the complaint. Nelson, who was driving for Knife River Corp., failed to also slow and struck the back of Scoggins's vehicle, the suit states.

In addition to her pain and suffering, Boyd endured mental anguish, incurred medical costs, sustained physical impairment and lost earnings and her earning capacity, the complaint says.

Boyd blames Nelson for causing the collision, saying he negligently failed to control his speed, failed to keep a proper lookout, failed to pay attention, failed to timely apply his brakes, failed to take evasive action to avoid a collision and drove in a reckless manner.

In her complaint, Boyd seeks a judgment within the jurisdictional limits of Jefferson County District Court, plus pre- and post-judgment interest, costs and other relief the court deems just.
