PU files petition to perpetuate testimony in likely asbestos suit

Area resident Lucille Bennett has filed a petition to perpetuate the testimony of James Bennett, who allegedly suffers from asbestos-related lung cancer.

Through Provost Umphrey attorney Keith Hyde, the petition was filed July 24 in Jefferson County District Court. The anticipated defendant in the pending suit is ExxonMobil.

According to the petition, Bennett was diagnosed with asbestos-related lung cancer, which "is expected to progress" and prove fatal.

The petition does not say when he was diagnosed.

The petition seeks Bennett's testimony concerning his employment with Mobil and asbestos exposure.

The petition states a wrongful death suit will be filed.

Judge Gary Sanderson, 6oth District Court, is assigned to the case.
