Apache Industrial sues Pabtex to recover $336K for services rendered

Seeking to recover more than $336,000 for services rendered, Apache Industrial Services has filed suit against Pabtex Inc. alleging the company refuses to honor an agreement.

The suit was filed July 25 in Jefferson County District Court.

According to the lawsuit, Apache is an industrial painting contractor. Pursuant to an agreement, Apache provided equipment, material and services to Pabtex, including the preparation and painting of Pabtex's stacker, shiploader and related equipment.

Apache has performed all contractual obligations; however, despite demands for payment, Pabtex has refused to pay for the remaining contract amount owed of $336,520.50.

The suit accuses Pabtex of breaching its contract.

"Apache provided equipment, labor services and materials to Pabtex on the project, the benefit of such which was accepted by Pabtex," the suit states. "Pabtex's acceptance was under circumstances which Pabtex knew ... that Apache expected payment."

The plaintiff is suing for actual damages, interest and court costs, including attorney's fees.

Houston attorney Seth Russell of Andrews Myers represents the company.

Judge Milton Shuffield, 136th District Court, is assigned to the case.
