Wreck at red light in Silsbee subject of lawsuit

A woman has filed suit against the driver who she claims rear-ended her vehicle as she sat stopped at a traffic light.

Ralynda Mizell Flebbe claims she was sitting at a traffic light at the intersection of U.S. Highway Business 96 South and Durdin Drive in Silsbee on July 30, 2010, when defendant Landon Harris Carr, who was driving a vehicle for defendant Carr Brothers Corp., struck the back of Flebbe's vehicle.

Because of the collision, Flebbe sustained serious injuries to her neck, back and arms; incurred medical costs; and experienced physical pain, suffering, physical impairment and mental anguish, according to the complaint filed July 24 in Jefferson County District Court. She also lost earnings, the suit states.

Carr negligently failed to keep a proper lookout, failed to keep the same distance from Flebbe's vehicle that an ordinary driver would have, drove too fast and failed to apply his brakes in a timely manner, the complaint says.

In her complaint, Flebbe is seeking a judgment for damages within the jurisdictional limits of Jefferson County District Court, plus post-judgment interest at the legal rate, costs and other relief the court deems just.

The case has been assigned to Judge Donald Floyd, 172nd District Court.
