Woman sues manufacturer after hernia mesh becomes infected

MARSHALL - After suffering injuries due to infection, a White Oak woman has filed a lawsuit against the manufacturer of the surgical mesh that was used to treat her hernia.

Shelly K. Coppedge filed suit against Ethicon Inc. on Aug. 2 in the Eastern District of Texas, Marshall Division.

According to the suit, on or about Aug. 24, 2009, the plaintiff was treated at East Texas Medical Center in Tyler for an incisional hernia. The surgeon used Proceed Oval Mesh, manufactured, designed and marketed by Ethicon.

She states that by June and July of 2011, her condition had worsened.

Coppedge claims she required subsequent surgeries to try to remedy the complications cause by the mesh, "including a disintegration of the mesh and infection of the mesh."

"Even after the two subsequent surgeries, Plaintiff Shelly K. Coppedge continues to suffer various infirmities due to complications caused by the Proceed mesh that was designed, marketed, and tested by Defendant Ethicon, Inc.," the suit states.

The defendant is accused of negligence, strict liability and breach of warranty.

The amount in controversy, exclusive of interest and costs, exceeds the sum of $75,000.

The plaintiff is asking the court for an award of medical expenses, loss of wages, loss of wage earning capacity, physical impairment, pain and mental anguish, loss of enjoyment of life, punitive damages, interest, court costs and attorney's fees.

A jury trial is requested.
