Medical malpractice suit filed over botched hysterectomy

Area resident Alicia Smith is suing Dr. Maxie Sprott II and the Center for Women's Health and Birth Care, alleging the defendants were negligent in performing her hysterectomy more than two years ago.

The suit was filed Aug. 6 in Jefferson County District Court.

According to the lawsuit, on May 24, 2010, Smith underwent a hysterectomy performed by Dr. Sprott, a CWHBC employee.

"When this case is tried, the evidence will show ... Sprott breached the standard of care with respect to his care and treatment of Smith, including ... the manner in which her (hysterectomy was performed) and post-operative care," the suit states.

Specific details on how the surgery performed was negligent are not included in the suit.

The plaintiff is suing for her alleged past and future medical expenses, mental anguish, pain, impairment, disfigurement and lost wages, plus all court costs.

Houston attorney Craig Lewis represents her.

Judge Donald Floyd, 172nd District Court, is assigned to the case.
