A lawsuit against Golden Corral, who was sued by a woman alleging she slipped and fell in a puddle of water on the floor of the restaurant, is set to go to trial in September.
As previously reported, Plaintiff Cynthia Trigg, a Dallas County resident, filed suit against Golden Corral on Jan. 26, 2009, in Jefferson County District Court.
The case was set to go to trial last year, but Golden Corral filed a motion for continuance on Feb. 11, 2011, arguing "that its attorney, Michael McGown, is undergoing total hip replacement surgery."
Judge Gary Sanderson of the 60th District Court granted the motion four days later.
A court official told the Southeast Texas Record that the case is set for trial on Sept. 24.
Court records show Trigg was eating at the Beaumont Golden Corral off Interstate 10 on April 1, 2007, when she slipped on a puddle of streaming water on the floor near a buffet line.
Because of her fall, Trigg claims she sustained a torn anterior cruciate ligament.
She is suing for her physical pain, mental anguish, lost earnings, a damage to her earning capacity, physical impairment, disfigurement and incurred medical expenses.
McGown is an attorney for the Beaumont law firm Benckenstein, Norvell and Nathan.
