Beaumont man blames stop-sign runner for crash on Gladys

A Beaumont man has filed suit against the driver who he claims failed to yield the right-of-way at a stop sign and struck his vehicle.

Warren Frank Ferguson claims he was driving west in the 3900 block of Gladys Street in Beaumont on Nov. 15, 2010, when defendant Bethany Henry struck his vehicle after failing to yield the right-of-way at a stop sign.

Because of the collision, Ferguson incurred medical costs; experienced physical pain, suffering and physical impairment; and lost earnings, according to the complaint.

Henry negligently failed to keep a proper lookout, failed to turn her vehicle to avoid a collision, failed to keep a safe distance from Ferguson’s vehicle, failed to stop or yield at a traffic control device and failed to enter the intersection only when it was safe to do so, the suit states.

In his complaint, Ferguson is seeking a judgment within the jurisdictional limits of Jefferson County District Court, plus exemplary damages, pre-judgment interest at the maximum rate allowed by law, post-judgment interest at the legal rate, costs and other relief the court deems just.

The case has been assigned to Judge Bob Wortham, 58th District Court.
