Man claims ankle fractured during wreck

A Jefferson County man claims he suffered a fractured right ankle after a driver failed to yield the right-of-way at an intersection and struck his vehicle.

Mark Allen filed a lawsuit Aug. 22 in Jefferson County District Court against Margaret Zarnstorff.

In his complaint, Allen alleges he drove south on Spur 93 on Feb. 11 when Zarnstorff, who drove north on the same road, attempted to turn left and struck Allen’s vehicle.

In addition to his fractured right ankle, Allen incurred medical costs; experienced mental anguish, physical pain, suffering and disability; lost wages; and sustained physical impairment because of the collision, according to the complaint.

Allen blames Zarnstorff for causing the collision, saying she negligently failed to yield the right-of-way and drove inattentively.

In his complaint, Allen seeks damages in excess of the minimum jurisdictional limits of Jefferson County District Court, plus costs, pre- and post-judgment interest and other relief the court deems just.

Clay Dugas and Reginald Blakeley of Beaumont will be representing him.

Judge Milton Shuffield, 136th District Court, has been assigned to the case.
