Four days into trial, Signal settles breach of contract case

Four days into a trial, Signal International opted to settle a suit brought by a Louisiana-based business claiming considerable costs after a crane and man-lift it leased sunk under Signal’s watch.

As the Southeast Texas Record reported in February 2010, Rectec filed a lawsuit in Jefferson County District Court against Signal International and Fireman’s Fund Insurance Co.

Jury selection in case began Sept. 10. Four days later, Signal opted to settle rather than let a jury decide the outcome.

Court papers show Rectec leased the crane and man-lift in August 2009. Under an oral agreement, Rectec agreed to allow Signal to use the leased equipment at its dry dock in Port Arthur.

According to the original petition, while Signal used the machines someone left a valve open at the dry dock and allowed it to sink, resulting in the total loss of the crane and man-lift.

Rectec was seeking actual and consequential damages.

The company is represented by Houston attorney Margaret Sunkel.
