Man suffers deteriorating medical condition after wreck, suit claims

A Jefferson County man has filed suit against the driver who he claims failed to yield the right-of-way at a red light.

Thomas Dominguez alleges he was driving west on Eighth Street at its intersection with Magnolia in Port Neches on Oct. 4, 2011. At the same time, defendant Susan Ann Delgado-Watts failed to stop at a red light and unexpectedly struck Dominguez’s vehicle, according to the complaint filed Sept. 6 in Jefferson County District Court.

Because of the collision, Dominguez experienced a deteriorated physical and mental condition, suffered great physical and mental pain and anguish and incurred medical costs, the suit states. He also lost earnings and his earning capacity, incurred a substantial drop in the value of his one-month-old vehicle and racked up $4,520.20 in rental car costs, the complaint says.

Dominguez blames Delgado-Watts for causing the collision, saying she negligently failed to keep a proper lookout, failed to control her speed, failed to drive in a safe manner, failed to turn to avoid a collision, failed to apply her brakes, failed to keep her vehicle under proper control, failed to yield the right-of-way, failed to stop at an intersection and failed to proceed through the intersection only when it was safe to do so.

Dominguez also names Alex Esquivel as a defendant. Esquivel negligently allowed Delgado-Watts to drive his vehicle, according to the complaint.

In his complaint, Dominguez is seeking an unspecified judgment, plus interest at the legal rate, costs and other relief the court deems just.

Gordon D. Friesz of McPherson, Hughes, Bradley, Wimberley, Steele and Chatelain in Port Arthur will be representing him.

The case has been assigned to Judge Milton Shuffield, 136th District Court.
