Beaumont Sam’s Club sued after customer slips in spilled soft drink

After slipping in a spilled soft drink and falling, a Jasper County woman has filed a lawsuit against a Sam’s Club store claiming that the store knew about the spill but failed to warn shoppers and failed to clean it up. 

Doris Porter Limbrick filed suit against Sam’s Club Store #8275 in Jefferson County Court. The defendant removed the case to the federal Eastern District of Texas, Beaumont Division.

Limbrick claims that she slipped on a foreign substance which was on the floor, which caused her to fall. The defendant is accused of negligence of knowing that there was cola on the floor and failing to adequately correct and warn of the cola.

The plaintiff is seeking damages for medical expenses, physical pain, mental suffering, physical impairment, loss of earning capacity, reduced ability to perform household services, interest and court costs.

Limbrick is represented by Curtis W. Leister of Reaud, Morgan & Quinn in Beaumont.

U.S. District Judge Thad Heartfield is assigned to the case.
