Guide Fabricators unfairly denied insurance coverage, suit says

GALVESTON - Complaining its property damage claim was not honored, Guide Fabricators Inc. has filed a lawsuit.

Court papers filed Sept. 20 in Galveston County District Court say Central Mutual Insurance Co. wrongfully denied the plaintiff's request for coverage in response to vandalism and theft to its San Leon business.

The structures were victimized by criminal activity twice in late 2010, and the complainant subsequently submitted documentation to initiate coverage.

Central assigned Nathan Perry, who is also a defendant, to adjust the claim.

Guide Fabricators asserts it submitted said claim in proper form and within the time specified in its policy, however, "the defendants have failed to pay for the damages, failed to properly account for all of the damages and properly estimate the value of such damages."

"The defendants have chosen to continue to deny timely payment of the damages to the buildings and contents," the suit says.

"As a result, the plaintiff has been unable to have the items replaced since the vandalism and theft."

According to the original petition, the defendants' actions and conduct in question inflicted "significant economic impact, worry, distress, and continuing economic and physical damage."

Consequently, the complainant seeks more than $125,000 in damages and a jury trial.

It is represented by attorney Christopher D. Bertini with The Bertini Law Firm P.C. in Galveston.

The case has been assigned to Galveston County 212th District Court Judge Susan Criss.
